Welcome to Agogoo! These Terms of Use govern your access and use of our Application and services. Please read them carefully before using our platform. For the purposes of these Terms:

  • Application: The software program provided by the Company, named Agogoo, downloaded by You on an electronic device.
  • Application Store: Digital distribution services such as Apple App Store or Google Play Store where the Application is made available.
  • Affiliate: An entity controlling, controlled by, or under common control with a party, with "control" meaning ownership of 50% or more of voting securities.
  • Country: Refers to Cameroon.
  • Company: Refers to Cowries Money Co Ltd, located at Mile 3 Nkwen, Bamenda, North West Region, Cameroon.
  • Device: Any device capable of accessing the Service, such as a smartphone, tablet, or computer.
  • Service: The features and functionalities provided by the Application.
  • Terms: Refers to this Terms of Use agreement.
  • Third-party Social Media Service: Any external service or content accessible through our Application.
  • You: The individual or entity accessing or using the Service.

2. Acknowledgment

By using the Service, You acknowledge that:

  • These Terms form the entire agreement between You and the Company regarding the use of the Service.
  • You are at least 18 years of age. Individuals under 18 are not permitted to use the Service.
  • You have read, understood, and agree to abide by these Terms and our Privacy Policy.
  • If You represent a company or other legal entity, You have the authority to bind such entity to these Terms.

Upon termination:

  • The Company reserves the right to delete Your data, subject to applicable laws and our Privacy Policy.

  • Payments are processed through the Application Store, and their terms govern transactions.
  • Refunds, if applicable, are handled as per the policies of the Application Store.

7. Limitation of Liability

To the maximum extent permitted by law:

  • The Company’s liability for damages is limited to the total amount paid by You for using the Service or $100 USD, whichever is higher.
  • We are not liable for indirect, incidental, or consequential damages, including loss of profits, data, or privacy.

8. "AS IS" and "AS AVAILABLE" Disclaimer

The Service is provided on an "AS IS" and "AS AVAILABLE" basis.

  • The Company disclaims all warranties, express or implied, regarding the Service’s functionality, performance, and reliability.
  • We do not guarantee uninterrupted or error-free operation of the Service.

9. Governing Law

These Terms are governed by the laws of Cameroon, excluding its conflict of laws principles. Additional laws may apply based on Your location.

10. Dispute Resolution

For disputes, You agree to attempt an informal resolution by contacting us at support@agogoo.africa before pursuing legal remedies.

11. United States Legal Compliance

You represent and warrant that:

  • You are not located in a country subject to U.S. government embargoes.
  • You are not listed on any restricted parties list maintained by the U.S. government.

12. Severability

If any provision of these Terms is deemed unenforceable, the remaining provisions will remain in effect.

13. Modifications

The Company reserves the right to update these Terms at any time. If changes are material, we will notify You at least 30 days before they take effect. Continued use of the Service after updates constitutes Your acceptance.
